Case Overview

On July 9, 2014, Ruben Juarez — a recipient of the federal government’s Deferred Action for Childhood Arrivals (“DACA”) program — filed a class action lawsuit against Northwestern Mutual Life Insurance Co., Inc., in the United States District Court for the Southern District of New York. This complaint is filed on behalf of all persons who are legally authorized to work in the United States, but who were denied the right to work because they are not citizens or permanent residents (“greencard” holders). The suit claims that this denial of the right to make and enforce work contracts is alienage discrimination in violation of 42 U.S.C. Section 1981.

On November 14, 2014, the Honorable Katherine B. Forrest of the Southern District of New York denied Northwestern Mutual’s motion to dismiss and allowed the case to proceed, concluding that Outten & Golden’s client, Ruben Juarez, had stated a plausible claim under 42 U.S.C. § 1981. Mr. Juarez, a recipient of the Obama Administration’s DACA program, which provided him a legal work permit, alleged that Northwestern Mutual unlawfully excluded him from a financial representative internship because he was neither a U.S. citizen nor legal permanent resident and that Northwestern Mutual’s policy of excluding people like him violated § 1981, which requires companies to form employment contracts with non-citizens in the U.S. on the same terms and conditions as U.S. citizens.
